EIN Error 101 — What It Means and How to Fix It
EIN Error 101 means the IRS found another entity in its records with the same or similar name as your business, so the automated online EIN application was rejected. ZenBusiness will notify you by email and help you file IRS Form SS-4 manually — the SS-4 process takes 4–8 weeks and the IRS sends your EIN directly to you.
What Caused Error 101
The IRS's online EIN system does an automated name check. When it finds an existing entity with a name too similar to yours, it blocks the application and returns Error 101. This is an IRS-level conflict — it's not a ZenBusiness issue and doesn't mean there's a problem with your business formation (your state formation is still complete and valid).
Common causes:
- A previous business with the same name filed for an EIN (even if that business is now dissolved)
- A business in another state registered a similar name with the IRS
- Your business name contains common words that match many existing entities
What Happens Next
If your ZenBusiness EIN application returns Error 101:
- ZenBusiness emails you with an explanation and the next steps
- We help you prepare IRS Form SS-4 — the paper/fax application for an EIN
- The SS-4 is submitted to the IRS by mail or fax
- Processing takes 4–8 weeks — the IRS's manual review process is slower than online issuance
- The IRS sends your EIN Assignment Letter directly to you at the address on file — not through ZenBusiness
Your EIN will not appear in your ZenBusiness dashboard through the normal process if it's resolved via SS-4; the IRS mails the confirmation to your business address. Once you receive it, you can proceed with your business banking and other EIN-dependent tasks.
Faster Option: Call the IRS Directly
If you need your EIN urgently, you can bypass the SS-4 wait time by calling the IRS:
IRS Business & Specialty Tax Line: 1-800-829-4933
Hours: Monday–Friday, 7 AM–7 PM Eastern Time
If you call with your SS-4 information ready (business name, address, responsible party name, and SSN or ITIN), an IRS agent can issue your EIN over the phone immediately — you'll receive your EIN during the call.
Frequently Asked Questions
Does Error 101 mean my business name is taken?
Not necessarily your state business name — your state formation is already approved and your name is registered with the state. Error 101 is specifically an IRS name conflict for EIN purposes. You don't need to change your business name to resolve it; you just need to go through the SS-4 manual process.
Can I just get a different EIN with a slightly different name?
Not recommended. Your EIN should match your business's legal name. If you want to resolve Error 101 by changing your business name, you'd need a state amendment plus the SS-4 application under the new name. In most cases, it's faster to just submit the SS-4 with your current name and wait for IRS manual processing.
Will my state formation still be valid while I wait for my EIN?
Yes — your state formation is completely separate from your EIN. Your LLC or corporation is fully and legally formed even without the EIN in hand. The EIN is needed for banking and certain tax purposes, but your business exists from the moment your state approved the formation.
What if I don't respond to ZenBusiness's Error 101 notification?
Your EIN application will remain unresolved. ZenBusiness will attempt to follow up, but ultimately you need to provide the information needed to complete the SS-4. Contact support at (844) 493-6249 if you've missed the notification or need to restart the process.
